TFC Pro Membership Service Agreement v 3.0

1. Agreement to Terms

By signing up for The Foot Collective Pty Ltd (ABN 16 629 674 004) ("TFC") Pro Membership, you (the "Member") agree to abide by the terms outlined in this agreement. This agreement constitutes a legally binding contract between you and TFC, governing your membership and access to the TFC Pro Directory and related services.

2. Publicly Available Information

You acknowledge and agree that the professional details you provide in your TFC Pro profile will be made publicly available in the TFC Pro Directory upon completion of the onboarding process. It is your responsibility to ensure the accuracy and appropriateness of all information provided, as it will be accessible to members of the public.

You may update your profile information by contacting info@thefootcollective.com TFC will use reasonable endeavours to reflect updates promptly.

3. Educational Nature of Content

You understand and agree that the information, tools, resources, and training provided as part of the TFC Pro Membership are strictly educational and are not to be construed as medical advice. TFC's Pro content is designed to support your professional development and enhance your knowledge of TFC's approach to natural foot health. It is not a substitute for professional medical judgment, diagnosis, or treatment, and does not replace or supplement your registration obligations under any applicable health practitioner regulatory framework.

By signing up for the TFC Pro Membership, you also accept TFC's Content Disclaimer at https://thefootcollective.com/pages/content-disclaimer, which governs your access to and use of all TFC content including health and safety disclosures, contraindication guidance, assumption of risk, and intellectual property terms.

4. Scope of Practice

You agree to act within your professional scope of practice at all times when applying or teaching knowledge or tools from TFC's Pro Membership. TFC is not responsible for any actions you take that exceed your professional qualifications or violate regulations governing your profession.

Your TFC Pro certification is an educational credential. It does not expand, alter, or certify your scope of practice under any professional regulatory framework (including AHPRA registration, General Medical Council registration, or equivalent).

5. Liability

To the fullest extent permitted by applicable law, you agree to release, waive, and hold harmless The Foot Collective Pty Ltd (ABN 16 629 674 004), its employees, officers, directors, and affiliates from any and all claims, demands, or causes of action arising out of or related to your use of TFC Pro Membership resources. This includes claims related to the misuse of educational content or tools.

Nothing in this clause limits any rights you have that cannot be excluded under the Australian Consumer Law, the UK Consumer Rights Act 2015, or equivalent mandatory consumer protection legislation in your jurisdiction.

6. Intellectual Property

All content, tools, resources, and materials provided through TFC's Pro Membership - including content on the TFC App and Kajabi platform - are the intellectual property of The Foot Collective Pty Ltd (ABN 16 629 674 004).

You agree not to:

  • copy, distribute, reproduce, sell, or share TFC Pro materials outside the membership context;

  • use TFC Pro materials to develop competing courses, products, or programs;

  • sublicence or transfer access to TFC Pro materials to any third party.

7. Privacy and Data Use

The Foot Collective Pty Ltd (ABN 16 629 674 004) will use your personal information in accordance with its Privacy Policy at **https://thefootcollective.com/policies/privacy-policy**.

By signing up for the TFC Pro Membership, you consent to the use of your professional information for:

  • inclusion in the TFC Pro Directory (public-facing professional profile);

  • communication about updates, events, professional development opportunities, and TFC program changes;

  • administration of your membership account.

You may update or withdraw your Pro Directory listing by contacting pro@thefootcollective.com.

8. Membership Conduct

As a member of the TFC Pro community, you agree to:

  • maintain professionalism in interactions with other members and clients;

  • avoid any actions that could harm the reputation or integrity of TFC;

  • use TFC resources responsibly, ethically, and within the educational scope they are intended for;

  • not misrepresent the nature of TFC's certification (educational) as regulatory registration or clinical credentialling;

  • not represent TFC services to clients as clinical services.

9. Membership Termination

TFC reserves the right to suspend or terminate your Pro Membership at any time if you:

  • violate the terms of this agreement;

  • engage in conduct detrimental to TFC's mission, community, or reputation;

  • misrepresent TFC's certification scope to clients or the public;

  • fail to maintain any professional registration required for your practice.

Upon termination, your Pro Directory listing will be removed and your access to Pro membership resources will cease.

10. Amendments

TFC reserves the right to amend this agreement at any time. Where changes are material, TFC will notify Members by email or via the membership platform at least 30 days before changes take effect. Continued participation in the Pro Membership after changes take effect constitutes acceptance of the amended terms.

11. Governing Law

This agreement is governed by and construed in accordance with the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.

Mandatory consumer protections applicable in your jurisdiction apply to the extent they cannot be displaced by the choice of Queensland law.

12. Acknowledgement and Agreement

By signing up for the TFC Pro Membership, you acknowledge that you have read, understood, and agree to the terms of this Service Agreement.
