TFCÂ GUIDE MEMBERSHIP SERVICE AGREEMENTÂ
1. Agreement to Terms
By signing up to the TFC Guide Membership, you ("the Guide") confirm that you have read, understood, and agree to the terms of this Guide Membership Agreement. This agreement governs your relationship with The Foot Collective Pty Ltd (ABN 16 629 674 004) ("TFC") as a Guide Member from sign-up. Certification-related permissions in Clause 2 take effect on completion of TFC Guide Certification.
This agreement applies to all Guide Members - including those who have completed TFC Guide Certification and those who are working toward it.
If you wish to deliver official TFC-branded events, workshops, or online classes, you must also sign TFC's Certified Guide Contractor Agreement before doing so. That agreement is separate from and additional to this one.
2. Guide Identity - Permitted Descriptions
Your permitted descriptions depend on where you are in the certification process.
A. During Guide Training (before certification is confirmed)
While completing your TFC Guide Certification through the Guide Training Library in Kajabi, you may:

describe yourself as "currently completing my TFC Guide Certification" or "in training with The Foot Collective in foot health education"; and
-
apply knowledge and skills you develop through TFC's Guide training within your own professional scope of practice.
You must not, before your certification is confirmed:
-
identify yourself as a "TFC Certified Guide" or any equivalent; or
-
imply that you hold, or have completed, TFC Guide Certification.
B. On completion of certification
Your TFC Guide Certification is confirmed when you have completed all required training modules and assessments in the TFC Guide Training Library, and TFC records your certification status in Kajabi. Once confirmed, you may:

identify yourself as a "TFC Certified Guide" in your professional biography, social media profiles, client communications, and verbal introductions;

state that you "hold certification from The Foot Collective" or that you have trained with The Foot Collective in foot health education; and
-
apply the knowledge, skills, and frameworks developed through your TFC Guide Certification in your professional practice.
These permissions apply in all professional contexts and regardless of whether you are running official TFC events.
3. Brand Use Restrictions - Personal and Professional Events
When you run events, classes, or sessions in a personal or professional capacity that are not official TFC-branded events, you must not:
(a) use TFC's name, logos, trade marks, brand colours, typography, or design elements to promote or describe the event;
(b) imply TFC's endorsement, sponsorship, or involvement in the event; or
(c) use any combination of visual elements - including fonts, colours, layout, or design style - from which a reasonable person could infer that TFC is associated with, endorsing, or involved in the event, even where TFC's name does not appear.
The prohibition in (c) applies regardless of intent. The test is whether a reasonable observer could infer TFC association from the materials.
What you may say in personal event contexts:Â You may state in your biography, social media profile, or verbal introduction that you hold TFC certification or train with TFC in foot health education. You may not present that certification as TFC's endorsement of your personal event.
If you wish to run an event using TFC's brand, name, or methodology under TFC's promotional support, you must follow TFC's event classification and approval process and sign the Certified Guide Contractor Agreement.
4. Marketing Claims
When your content, communications, or professional materials reference TFC products, programs, events, or methodology in any public-facing format - including social media, client communications, event marketing, professional presentations, or any other channel - you must:
(a) describe TFC products and programs as educational and movement training tools only;
(b) not make any claim that any TFC product or program treats, cures, manages, prevents, diagnoses, or reduces the symptoms of any health condition — including plantar fasciitis, flat feet, bunions, Achilles tendinopathy, or any other named condition;
(c) not publish before-and-after content, outcome statistics, or clinical comparisons that imply therapeutic benefit or health condition improvement attributable to TFC products or programs;
(d) not use clinical language — including "treatment", "rehabilitation", "therapeutic", "prescription", or "clinically proven" — to describe TFC products, programs, or their outcomes;
(e) not republish or share any third-party testimonial that links TFC products or programs to improvement in a named health condition; and
(f) in any public content where you positively reference TFC products, programs, or events in your capacity as a TFC Certified Guide, clearly and conspicuously disclose your Guide relationship with TFC. Accepted disclosure labels: TFC Guide, #ad, or Paid Partnership. The disclosure must appear at the start of the content and be readily visible without user action.
These obligations apply in all contexts and regardless of your professional qualifications.
Breach of this clause is grounds for suspension under Clause 7.
5. Scope of Practice
When acting in any capacity that references your TFC certification or applies TFC knowledge, you must act within your professional scope of practice.
Your TFC Guide Certification is an educational credential. It does not expand, alter, or certify your scope of practice under any professional regulatory framework, including AHPRA registration, General Medical Council registration, or equivalent.
TFC's education is not a clinical service and must not be presented or represented as one, regardless of your professional qualifications.
If you are a registered health practitioner (including under AHPRA, the General Medical Council, or an equivalent registration body), you remain independently subject to your profession's advertising obligations. Using your TFC Guide Certification in advertising your clinical practice must comply with those obligations. TFC accepts no responsibility for your compliance with professional registration advertising rules.
6. Community Standards
TFC operates community spaces for Guides and members. As a Guide Member, you agree to participate in TFC community spaces in accordance with TFC's Community Guidelines, accessible in the Community section of the TFC app.
You must not engage in conduct that harms TFC's community, members, or reputation in any TFC-operated or TFC-associated space.
7. Suspension and Termination
TFC may suspend or terminate your Guide Membership if you:
(a) use TFC's brand, visual identity, or trade marks to promote personal events or services in breach of Clause 3;
(b) make prohibited health or clinical claims in breach of Clause 4;
(c) act outside your professional scope in a way that creates risk for participants or reputational harm for TFC;
(d) engage in conduct that is seriously inconsistent with TFC's community standards or values; or
(e) breach any other term of this agreement.
For minor or first breaches, TFC will notify you in writing and allow a reasonable opportunity to remedy the breach before taking action. For serious or repeated breaches, TFC may act immediately.
Suspension or termination of your Guide Membership under this clause does not automatically affect your certification status, which is managed through TFC's separate certification processes.
8. Intellectual Property
All TFC educational frameworks, methodologies, tools, training materials, curricula, and trade marks are the intellectual property of The Foot Collective Pty Ltd (ABN 16 629 674 004). Your Guide Certification does not grant you any intellectual property rights in TFC's materials or methods.
You may apply general knowledge and skills developed through your certification in your professional practice. You must not reproduce, adapt, or directly incorporate TFC's specific frameworks, curricula, branded materials, or trade marks in any commercial product, course, or service without TFC's prior written consent.
9. Amendments
TFC may amend this agreement at any time. Where changes are material, TFC will notify you by email at least 30 days before changes take effect. Continued participation in the TFC Guide programme after changes take effect constitutes acceptance of the updated terms.
10. Governing Law
This agreement is governed by the laws of Queensland, Australia. Mandatory consumer protections applicable in your jurisdiction apply to the extent they cannot be displaced by the choice of Queensland law.
11. Acknowledgement
By signing up to the TFC Guide Membership, you acknowledge that you have read, understood, and agree to the terms of this Guide Membership Agreement.
