TFC GUIDE MEMBERSHIP SERVICE AGREEMENT

1. Agreement to Terms
By signing up to the TFC Guide Membership, you ("the Guide") confirm that you have read, understood, and agree to the terms of this Guide Membership Agreement. This agreement governs your relationship with The Foot Collective Pty Ltd (ABN 16 629 674 004) ("TFC") as a Guide Member from sign-up. Certification-related permissions in Clause 2 take effect on completion of TFC Guide Certification.
This agreement applies to all Guide Members - including those who have completed TFC Guide Certification and those who are working toward it.
If you wish to deliver official TFC-branded events, workshops, or online classes, you must also sign TFC's Certified Guide Contractor Agreement before doing so. That agreement is separate from and additional to this one.
Guide and Pro Membership are separate TFC roles. Each is governed by a separate agreement. Rights and obligations under this agreement do not transfer to or from the TFC Pro Membership. If you hold both Guide and Pro membership, the obligations under each agreement apply independently.
Eligibility. By signing up to the TFC Guide Membership, you confirm that you are a health or movement professional, are currently working toward a health or movement qualification, or have been expressly invited by TFC to access Guide training for personal learning and development only. TFC relies on this confirmation as the basis for providing access to the Guide Training Library. Providing inaccurate information is a material breach of this agreement.
If you access Guide training under an express invitation for personal learning only, and do not hold and are not working toward a relevant health or movement qualification, your access is limited to personal learning and development. It does not entitle you to identify as a TFC Certified Guide, deliver TFC events, or apply TFC frameworks in any professional, public, or commercial capacity.
You must notify TFC at info@thefootcollective.com if your professional status changes materially after sign-up. A material change includes ceasing to practise in the relevant profession, losing a qualification or registration on which your eligibility is based, or a significant change in the nature of your practice that no longer falls within the eligibility categories described in this clause. Failure to notify TFC of a material change is a material breach of this agreement.
2. Guide Identity - Permitted Descriptions
Your permitted descriptions depend on where you are in the certification process.
A. During Guide Training (before certification is confirmed)
While completing your TFC Guide Certification through the Guide Training Library in Kajabi, you may:

describe yourself as "currently completing my TFC Guide Certification" or "in training with The Foot Collective in foot health education"; and
-
apply knowledge and skills you develop through TFC's Guide training within your own professional scope of practice.
You must not, before your certification is confirmed:
-
identify yourself as a "TFC Certified Guide" or any equivalent; or
-
imply that you hold, or have completed, TFC Guide Certification.
B. On completion of certification
Your TFC Guide Certification is confirmed when you have completed all required training modules and assessments in the TFC Guide Training Library, and TFC records your certification status in Kajabi. Once confirmed, you may:

identify yourself as a "TFC Certified Guide" in your professional biography, social media profiles, client communications, and verbal introductions;

state that you "hold certification from The Foot Collective" or that you have trained with The Foot Collective in foot health education; and
-
apply the knowledge, skills, and frameworks developed through your TFC Guide Certification in your professional practice.
These permissions apply in all professional contexts and regardless of whether you are running official TFC events.
3. Brand Use Restrictions - Personal and Professional Contexts
When you run events, workshops, classes, or sessions, or create, market, or sell programs, courses, products, or online offerings in a personal or professional capacity that are not official TFC-branded activities, you must not:
(a) use TFC's name, logos, trade marks, brand colours, typography, or design elements to promote, describe, or associate your offering with TFC;
(b) imply TFC's endorsement, sponsorship, or involvement in any personal or commercial offering;
(c) use any combination of visual elements - including fonts, colours, layout, or design style - from which a reasonable person could infer that TFC is associated with, endorsing, or involved in your offering, even where TFC's name does not appear; or
(d) include TFC products in a personal or commercial program, course, kit, or offering in a manner that implies TFC has endorsed, co-created, or approved that program, or implies a commercial relationship between TFC and that program beyond the fact that TFC products are used within it.
The prohibition in (c) applies regardless of intent. The test is whether a reasonable observer could infer TFC association from the materials.
What you may do in personal and professional contexts: You may state in your biography, social media profile, or verbal introduction that you hold TFC certification or train with TFC in foot health education. You may truthfully state that you use TFC products in your professional practice. You may not present your TFC certification as TFC's endorsement of your personal programs, events, or commercial offerings.
If you wish to run an event using TFC's brand, name, or methodology under TFC's promotional support, you must sign TFC's Certified Guide Contractor Agreement and follow TFC's event facilitation requirements, which TFC will communicate to you before you begin.
4. Marketing Claims
When your content, communications, or professional materials reference TFC products, programs, events, or methodology in any public-facing format - including social media, client communications, event marketing, professional presentations, or any other channel - you must:
(a) describe TFC products and programs as educational and movement training tools only;
(b) not make any claim that any TFC product or program treats, cures, manages, prevents, diagnoses, or reduces the symptoms of any health condition - including plantar fasciitis, flat feet, bunions, Achilles tendinopathy, or any other named condition;
(c) not publish before-and-after content, outcome statistics, or clinical comparisons that imply therapeutic benefit or health condition improvement attributable to TFC products or programs;
(d) not use clinical language - including "treatment", "rehabilitation", "therapeutic", "prescription", or "clinically proven" - to describe TFC products, programs, or their outcomes;
(e) not republish or share any third-party testimonial that links TFC products or programs to improvement in a named health condition; and
(f) in any public content where you positively reference TFC products, programs, or events in your capacity as a TFC Certified Guide, clearly and conspicuously disclose your Guide relationship with TFC. Accepted disclosure labels: TFC Guide, #ad, or Paid Partnership. The disclosure must appear at the start of the content and be readily visible without user action.
These obligations apply in all contexts and regardless of your professional qualifications.
Breach of this clause is grounds for suspension under Clause 7.
5. Scope of Practice
When acting in any capacity that references your TFC certification or applies TFC knowledge, you must act within your professional scope of practice.
Your TFC Guide Certification is an educational credential. It does not expand, alter, or certify your scope of practice under any professional regulatory framework, including AHPRA registration, General Medical Council registration, or equivalent.
TFC's education is not a clinical service and must not be presented or represented as one, regardless of your professional qualifications.
If you are a registered health practitioner (including under AHPRA, the General Medical Council, or an equivalent registration body), you remain independently subject to your profession's advertising obligations. Using your TFC Guide Certification in advertising your clinical practice must comply with those obligations. TFC accepts no responsibility for your compliance with professional registration advertising rules.
6. Community Standards
TFC operates community spaces for Guides and members. As a Guide Member, you agree to participate in TFC community spaces in accordance with TFC's Community Guidelines, accessible in the Community section of the TFC app.
You must not engage in conduct that harms TFC's community, members, or reputation in any TFC-operated or TFC-associated space.
7. Suspension and Termination
7.1 Immediate termination
TFC may terminate your Guide Membership immediately, without notice, if you:
(a) make prohibited health or clinical claims about TFC products or programs in breach of Clause 4;
(b) misrepresent TFC's certification scope, mission, positions, or policies to clients or the public, including by publicly attributing to TFC views or positions that TFC does not hold;
(c) engage in hate speech, vilification, harassment, threats, or abuse toward any person, including TFC customers, members, staff, or community participants, whether in TFC-operated spaces or otherwise;
(d) engage in conduct constituting or involving criminal activity that creates a serious risk to the safety of others or causes serious reputational harm to TFC; or
(e) take actions that create an imminent risk to the safety of a participant or third party.
7.2 Termination with notice
For breaches not covered by Clause 7.1, including use of TFC's brand in breach of Clause 3, conduct inconsistent with TFC's community standards, or failure to notify TFC of a material change to professional status, TFC will provide at least 7 days' written notice before termination takes effect.
During that 7-day period, you may contact info@thefootcollective.com to address the breach. If resolved to TFC's reasonable satisfaction, TFC may withdraw the notice.
7.3 Administrative termination
If you no longer meet TFC's eligibility requirements for your membership category - for example, because your professional status has changed materially - TFC may terminate your membership on 14 days' written notice. Termination under this clause does not constitute a misconduct finding.
7.4 Suspension pending investigation
For any serious alleged breach, TFC may suspend your Guide Membership access while it investigates. TFC will notify you of the suspension and will aim to complete its investigation within 14 days.
7.5 Corrective action
Before proceeding to termination for a non-serious breach, TFC may require you to take corrective action within a specified timeframe. TFC will specify a timeframe of not less than 7 days, having regard to the nature of the breach. This may include removing or editing content, retracting a statement, or ceasing particular conduct. Failure to comply within the specified timeframe is a material breach of this agreement.
7.6 Effect of termination
(a) Administrative or eligibility termination (Clauses 7.2 or 7.3): Your access to Guide Membership resources ceases. This does not automatically revoke your TFC Guide Certification status, which is managed through TFC's separate certification processes.
(b) Misconduct termination (Clause 7.1): Your access to Guide Membership resources ceases. TFC may revoke any TFC-granted titles and certifications associated with your membership, including your "TFC Certified Guide" status. TFC will notify you in writing if revocation applies. On receipt of a revocation notice, you must immediately stop identifying yourself as a TFC Certified Guide, remove TFC badges, labels, and certification claims from your profiles, materials, and communications, and not imply TFC's endorsement or affiliation in any context.
(c) Reinstatement following any form of termination is at TFC's sole discretion.
8. Intellectual Property
All TFC educational frameworks, methodologies, tools, training materials, curricula, and trade marks are the intellectual property of The Foot Collective Pty Ltd (ABN 16 629 674 004). Your Guide Membership or Guide Certification does not grant you any intellectual property rights in TFC's materials or methods.
You agree not to:
(a) copy, distribute, reproduce, sell, or share TFC Guide training materials outside the membership context;
(b) allow any other person to access your Guide Training Library or use your Guide Membership credentials on their behalf;
(c) reproduce, adapt, or directly incorporate TFC's specific frameworks, curricula, training sequences, branded materials, or trade marks in any commercial product, course, or program without TFC's prior written consent, whether during your membership or after its termination;
(d) reteach, repackage, or explicitly claim authorship or original ownership of TFC's specific educational frameworks, methodologies, or training systems in any commercial, professional, or public context; or
(e) sublicence or transfer access to TFC Guide materials to any third party.
You may apply general knowledge and skills developed through your Guide Certification in your professional practice. This clause applies to the reproduction or direct use of TFC's specific intellectual property, not to the independent application of general professional knowledge.
Breach of this clause is a ground for termination under Clause 7.
9. Amendments
TFC may amend this agreement at any time. Where changes are material, TFC will notify you by email at least 30 days before changes take effect. Continued participation in the TFC Guide programme after changes take effect constitutes acceptance of the updated terms.
10. Governing Law
This agreement is governed by the laws of Queensland, Australia. Mandatory consumer protections applicable in your jurisdiction apply to the extent they cannot be displaced by the choice of Queensland law.
11. Acknowledgement
By signing up to the TFC Guide Membership, you acknowledge that you have read, understood, and agree to the terms of this Guide Membership Agreement.
