1. Agreement to Terms
By signing up for The Foot Collective Pty Ltd (ABN 16 629 674 004) ("TFC") Explorer Membership, you (the "Member") agree to abide by the terms outlined in this agreement. This agreement constitutes a legally binding contract between you and TFC, governing your participation in TFC's Explorer Membership services.
2. What the Explorer Membership Includes
The TFC Explorer Membership provides access to TFC's educational content and live engagement services, which may include:

Live and recorded online movement classes;

Access to educational video content on TFC's Kajabi platform;

Live calls or Q&A sessions with TFC educators or health professionals;
-
Related community and resource access as specified at sign-up.
The specific inclusions of the Explorer Membership are as set out in the membership description at the time of sign-up. TFC may update membership inclusions with reasonable notice to members.
3. Educational Nature of Services
You understand and agree that the movement classes, live calls, Q&A sessions, and all other content provided as part of the TFC Explorer Membership are for educational and informational purposes only. These services are not:

a substitute for professional medical advice, diagnosis, or treatment;

a clinical service or health service as defined under applicable law;

a registered health practice;
-
advice to diagnose, treat, cure, or prevent any disease or condition.
Always consult a qualified, registered healthcare professional before making changes to your health or movement routine, particularly if you have a pre-existing injury or health concern.
By signing up for the TFC Explorer Membership, you also accept TFC's Content Disclaimer at https://thefootcollective.com/pages/content-disclaimer, which governs your access to and use of all TFC content including health and safety disclosures, contraindication guidance, assumption of risk, and intellectual property terms.
4. Assumption of Risk
You acknowledge that participation in movement classes and any physical guidance provided involves physical activity and carries inherent risks - including strains, sprains, falls, and in rare cases, more serious injury. By participating, you voluntarily assume full responsibility for any risks, known or unknown, that may occur as a result of your participation in these activities.
You agree to:

listen to your body during all activities;

stop immediately and seek medical advice if you experience pain, dizziness, or discomfort;

take personal responsibility for ensuring that activities are appropriate for your individual health and fitness level.
5. Limitation of Liability
To the fullest extent permitted by applicable law, you agree to release, waive, and hold harmless The Foot Collective Pty Ltd (ABN 16 629 674 004), its employees, educators, officers, directors, and affiliates from any and all claims, demands, or causes of action arising out of or related to your participation in TFC Explorer Membership services, including:
Nothing in this clause limits any rights you have that cannot be excluded under the Australian Consumer Law, the UK Consumer Rights Act 2015, or equivalent mandatory consumer protection legislation in your jurisdiction. TFC's liability for any breach of a non-excludable consumer guarantee is limited (to the extent permitted by law) to resupplying the services or refunding the membership fees paid.
6. Personal Responsibility
You are responsible for ensuring that activities undertaken through the TFC Explorer Membership are appropriate for your individual health and fitness level. If you have a medical condition, injury, or health concern, consult a healthcare professional before beginning.
7. Privacy and Data Use
The Foot Collective Pty Ltd (ABN 16 629 674 004) will use your personal information in accordance with its Privacy Policy at **https://thefootcollective.com/policies/privacy-policy**.
By signing up for the TFC Explorer Membership, you consent to the use of your information for:

providing access to Explorer Membership content and live sessions;

communicating about live classes, updates, and relevant TFC information;

administering your membership account.
8. Membership Conduct
As a member of the TFC Explorer community, you agree to:

participate respectfully and supportively in live classes, calls, and community spaces;

avoid any actions that could harm the reputation or integrity of TFC or its members;
-
not record, distribute, or share TFC live session content without TFC's prior written consent;

not share your login credentials with any third party.
9. Cancellation and Refunds
You may cancel your Explorer Membership at any time. Cancellation takes effect at the end of the current billing period. No refund is issued for unused days within a billing period unless required by applicable law.
Refund requests for exceptional circumstances (e.g. medical reasons with documentation) will be assessed at TFC's discretion.
Nothing in this clause limits your rights under the Australian Consumer Law or equivalent mandatory consumer protection legislation.
10. Membership Termination by TFC
TFC reserves the right to suspend or terminate your Explorer Membership if you:

violate the terms of this agreement;
-
engage in conduct detrimental to TFC's community or reputation;
-
misuse TFC's content or platform.
11. Amendments
TFC reserves the right to amend this agreement at any time. Where changes are material, TFC will notify Members by email or via the membership platform at least 30 days before changes take effect. Continued participation in the Explorer Membership after changes take effect constitutes acceptance of the updated terms.
12. Governing Law
This agreement is governed by and construed in accordance with the laws of Queensland, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.
Mandatory consumer protections applicable in your jurisdiction apply to the extent they cannot be displaced by the choice of Queensland law.
13. Acknowledgement and Agreement
By signing up for the TFC Explorer Membership, you acknowledge that you have read, understood, and agree to the terms of this Service Agreement.
