This disclaimer is issued by The Foot Collective Pty Ltd (ABN 16 629 674 004) ("TFC", "we", "us", "our"), a company registered in Queensland, Australia, with its registered address at 79 Sellheim St, Grange QLD 4051.

This disclaimer applies to all TFC content, wherever published, including:

  • Online training programs, courses, and educational videos (TFC App, Kajabi platform, website);
  • Free and paid digital content across all platforms and distribution channels;
  • Live and recorded online classes and educational sessions;
  • Social media content (Instagram, YouTube, Facebook, TikTok, LinkedIn, and any other platform on which TFC publishes content);
  • In-app guidance, movement instruction, curriculum materials, and educational frameworks;
  • Any other digital or online content published, distributed, or made available by TFC.

2. Scope and Related Documents

This disclaimer governs your access to and use of TFC's content. It operates alongside the following TFC compliance documents, which govern separate aspects of your relationship with TFC:

This disclaimer is a notice, not a waiver. For TFC's paid Kajabi programs and TFC App, a separate clickwrap acknowledgement is presented at point of purchase and/or first login. That clickwrap mechanism, not this disclaimer page, constitutes contractual acceptance of these terms for paid program participants.


3. Nature of TFC's Content - Educational, Not Clinical

By accessing TFC's content, you acknowledge and agree that TFC provides educational content only and is not providing clinical services.

TFC is an education company. All TFC content - including movement instructions, exercises, curriculum frameworks, methodology, case studies, and health information - is provided for general educational and informational purposes only.

TFC's content is not:

  • medical advice, clinical assessment, diagnosis, or clinical opinion;
  • a therapeutic or clinical service;
  • the practice of physiotherapy, podiatry, chiropractic, medicine, or any other regulated health profession under Australian, UK, EU, or US law;
  • a substitute for advice from a registered and qualified healthcare professional.

TFC is not a registered health practitioner. TFC's content does not constitute the practice of any regulated health profession. This applies regardless of the professional qualifications held by individual TFC presenters, educators, Pros, or Guides - when delivering TFC content, those individuals are acting as educators within TFC's educational framework, not as clinical practitioners.

Always consult a qualified, registered healthcare professional before beginning any new exercise program, making changes to your movement routine, or acting on health information - particularly if you have a pre-existing injury, medical condition, or health concern.


4. No Therapeutic Claims

TFC's content does not claim to diagnose, treat, prevent, cure, or manage any disease, injury, or health condition, including any foot condition.

Statements made in TFC's content have not been evaluated by the Therapeutic Goods Administration (TGA), the US Food and Drug Administration (FDA), or any equivalent regulatory body in any jurisdiction. TFC's content is not intended to diagnose, treat, cure, or prevent any disease.

Any general health information contained in TFC's content is educational only. TFC does not make clinical or therapeutic claims about the outcomes of its content for any individual.


5. Assumption of Risk

Participation in any movement-based activity - including exercises, practices, or techniques described or demonstrated in TFC's content - involves inherent risk of physical injury.

By choosing to participate, you:

  • voluntarily accept and assume all risks associated with participation in movement activities, including but not limited to: muscle strains, ligament sprains, tendon injuries (including Achilles tendon load injuries), stress fractures from load progression, plantar fascia strain, balance-related falls, and in rare cases more serious injury;
  • acknowledge that you have been made aware of the specific inherent risks set out in Section 6 of this disclaimer;
  • confirm that your participation is voluntary and that you have exercised your own judgement as to the suitability of TFC's content for your individual circumstances.

For the purposes of the Civil Liability Act 2003 (QLD) and equivalent legislation in other Australian states and territories, this section constitutes a risk warning. Participation after reading this warning constitutes voluntary assumption of the risks described.

This content disclaimer does not function as a waiver for in-person physical events. A separate signed Event Participant Release and Waiver is required for in-person participation.


6. Contraindicated Conditions and Emergency Stop Instruction

6.1 Medical Clearance - Named Contraindications

TFC's foot and movement content may not be appropriate for all individuals. You must seek medical clearance from a qualified healthcare professional before participating in TFC's content if you have any of the following conditions, or if you are unsure whether any of the following applies to you:

  • Diabetes (particularly where peripheral neuropathy is present - reduced sensation in the feet increases injury risk)
  • Peripheral vascular disease (reduced circulation to the lower limbs)
  • Active fracture or post-surgical recovery (foot, ankle, lower limb, or any condition that affects load-bearing)
  • Severe osteoporosis or osteopenia (increased fracture risk from load-bearing activities)
  • Balance and vestibular disorders (conditions affecting balance, stability, or proprioception)
  • Diagnosed cardiovascular conditions (for any content involving elevated intensity or cardiovascular exertion)
  • Pregnancy (modified activity is required; consult your healthcare provider before participating)
  • Active inflammatory arthropathies (rheumatoid arthritis, psoriatic arthritis, gout in active phase, or similar)
  • Any other condition for which a healthcare professional has advised you to limit or avoid physical activity

This list identifies specific foreseeable conditions for which TFC's content poses elevated risk. It is not exhaustive. If you have any concern about your suitability to participate, consult a healthcare professional before accessing TFC's content.

6.2 Emergency Stop Instruction

Stop immediately and seek emergency medical care if you experience any of the following during participation:

  • Chest pain or chest tightness
  • Shortness of breath or difficulty breathing
  • Sudden dizziness, lightheadedness, or loss of balance
  • Loss of consciousness or near-loss of consciousness
  • Sudden severe or sharp pain in any part of the body
  • Heart palpitations or irregular heartbeat
  • Numbness or tingling that was not present before activity

7. Healthcare Professionals - Professional Misuse Prohibition

TFC's content is not designed or approved for professional clinical application.

If you are a registered healthcare professional, certified personal trainer, exercise physiologist, or any other regulated or credentialled practitioner:

  • TFC's educational content does not constitute clinical guidance and must not be used as the basis for clinical decisions, referrals, or treatment plans;
  • Applying TFC's educational content in a professional clinical context is not authorised by TFC and is at your own professional risk;
  • TFC's content is not a substitute for your professional training, clinical guidelines, or scope-of-practice obligations;
  • Your professional indemnity obligations remain your sole responsibility.

The fact that individual TFC presenters hold professional healthcare qualifications does not alter the educational nature of TFC's content or authorise clinical application by any other healthcare professional.


8. Content Currency

TFC's content reflects the state of knowledge and evidence at the time of its production. Health, movement science, and rehabilitation science continue to evolve.

  • TFC's content may not reflect current scientific understanding or clinical evidence at the time you access it;
  • TFC endeavours to update its content regularly but does not guarantee that all content is current;
  • Older content in TFC's library (YouTube, App archive, Kajabi back-catalogue) may contain guidance that has since been revised or updated by TFC;
  • Content currency notices are not displayed on individual pieces of content - if you have any concern about whether specific content reflects current evidence, consult a registered healthcare professional.

9. Age Restrictions and Children

TFC's content and platforms are not intended for children under 13 years of age.

Persons under 13 must not use TFC's platforms or provide personal information to TFC without verifiable parental or guardian consent, as required under the US Children's Online Privacy Protection Act (COPPA). Under-16 restrictions apply to California residents under the California Consumer Privacy Act (CPRA) and California Online Privacy Protection Act (CalOPPA).

If TFC becomes aware that a person under 13 has provided personal information without appropriate consent, TFC will take steps to delete that information consistent with applicable law.

Where TFC's content is accessible by minors, parents and guardians are responsible for supervising their child's participation and for assessing the suitability of TFC's content for their child.


10. Privacy, Data, and Analytics

Washington State (US) - My Health My Data Act: If you are a resident of Washington State (US), your consumer health data rights under the Washington My Health My Data Act (WMHMDA) may apply to data collected through TFC's platforms, including movement and activity data collected through the TFC App. Please see our Privacy Policy at https://thefootcollective.com/policies/privacy-policy for details of how TFC handles consumer health data.

Photography and image data: If TFC collects participant images or video through the TFC App, live streaming, or other platforms, that collection is governed by our Privacy Policy. Specific consent processes are provided where applicable.


11. Clickwrap Acceptance and Version Records

For Kajabi program purchasers and TFC App users: A separate affirmative acceptance mechanism is presented at point of purchase and/or at first login. That mechanism, when completed, constitutes your contractual acknowledgement of the terms in this disclaimer, the TFC Terms of Service, and related agreements.

Version records: This disclaimer is versioned. The version number and effective date appear in the header of this document. TFC archives prior versions of this disclaimer with their effective date range. If you accessed TFC's content prior to the effective date of this version, the version of this disclaimer that was in effect at that time applies to that access.

12. Intellectual Property

12.1 Copyright

All TFC content - including videos, written materials, training programs, curriculum frameworks, coaching materials, exercises as presented, visual assets, and brand elements - is the copyright of The Foot Collective Pty Ltd (ABN 16 629 674 004). All rights reserved.

Copyright protection applies under the Copyright Act 1968 (AU), the Copyright, Designs and Patents Act 1988 (UK), 17 U.S.C. (US), and equivalent legislation in all jurisdictions where TFC's content is accessed.

All moral rights in TFC's content are reserved. TFC's creators retain the right of attribution and the right of integrity in TFC's content under the Copyright Act 1968 (AU) ss.193–195 and equivalent provisions in applicable jurisdictions. These moral rights are not waived.

12.2 Methodology and Compilation Works

TFC's program structures, curriculum sequences, educational methodology frameworks, and teaching systems are proprietary and protected as original compilation works. Individual exercises and movement instructions, where they are functional in nature, are protected as part of TFC's audiovisual content and curriculum compilations. TFC asserts full copyright in its audiovisual works and in the compiled structure and sequence of its programs.

12.3 User Licence

Subject to the terms of your applicable TFC membership or program agreement, TFC grants you a non-exclusive, non-transferable, non-sublicensable licence for personal, non-commercial use only.

This licence expressly excludes:

  • clinical application of TFC's content by any healthcare professional in a professional context;
  • sublicensing, redistribution, republishing, or commercial use of TFC's content;
  • use of TFC's content as the basis for commercial training programs, products, or services;
  • use of TFC's content as the basis for professional recommendations, referrals, or clinical decisions.

12.4 Platform Terms

TFC's disclaimer cannot override the terms of service of third-party platforms (YouTube, Meta, TikTok, Apple, Google). Where platform-specific requirements impose additional obligations on the display or presentation of health content, TFC will comply with those requirements. In the event of conflict between this disclaimer and a platform's terms of service, the platform's terms of service govern in respect of content distributed through that platform.

12.5 AI-Generated Content

Where TFC uses artificial intelligence tools to assist in the creation or delivery of content, TFC will provide disclosure in accordance with applicable law, including the EU AI Act 2024/1689 as it applies to health-adjacent content for EU users.


13. Testimonials and Individual Experiences

TFC is not a registered health practitioner and does not provide regulated health services under the Health Practitioner Regulation National Law (Australia).

Where TFC publishes testimonials, these reflect individual customer experiences only and do not constitute clinical evidence or therapeutic claims. Results vary between individuals and no specific outcome is guaranteed.

TFC does not claim that its content, products, or methodology can treat, prevent, or cure any foot condition or health condition.


14. Limitation of Liability

To the fullest extent permitted by applicable law, The Foot Collective Pty Ltd (ABN 16 629 674 004) and its officers, employees, contractors, educators, Pros, and Guides are not responsible for any injury, illness, health complication, loss, or adverse outcome arising from:

  • access to or use of TFC's content, platforms, or programs;
  • reliance on any health information contained in TFC's content;
  • participation in any movement activity described or demonstrated in TFC's content;
  • the acts or omissions of any third party in connection with TFC's content.

Results vary between individuals. TFC makes no guarantee of specific health, fitness, or movement outcomes from use of its content or programs.

14.1 Australian Consumer Law - Non-Excludable Guarantees

Nothing in this disclaimer excludes, restricts, or modifies any right or remedy, or any guarantee, warranty, or other term or condition, implied or imposed by the Australian Consumer Law (Schedule 2, Competition and Consumer Act 2010 (Cth)) that cannot lawfully be excluded or limited. This includes the statutory guarantees in ss.23–28 and s.64 of the Australian Consumer Law.

14.2 UK - Consumer Rights and Negligence

Nothing in this disclaimer limits TFC's liability for death or personal injury caused by TFC's own negligence under the Unfair Contract Terms Act 1977 (UK) s.2(1) or the Consumer Rights Act 2015 (UK) s.65.

Where TFC's content (including digital content) is supplied to a consumer in the United Kingdom, that consumer's statutory rights under the Consumer Rights Act 2015 - including the right to digital content that is of satisfactory quality, fit for purpose, and as described - are not affected by this disclaimer.

14.3 European Union - Consumer Rights and Product Liability

Where TFC's content is supplied to a consumer in the European Union, that consumer's rights under applicable EU consumer protection law - including the Consumer Rights Directive 2011/83/EU - are not affected by this disclaimer.

Nothing in this disclaimer excludes TFC's liability for damage caused by gross negligence or intentional misconduct (Vorsatz). This carve-out is stated as an explicit positive obligation and is not qualified by "to the fullest extent permitted by applicable law."

Nothing in this disclaimer purports to exclude TFC's liability for damage caused by a defective digital product as defined under the EU Product Liability Directive 2024/2853/EU (and implementing member state legislation). TFC's digital content - including exercise instruction content delivered through the TFC App and Kajabi platform - may fall within the scope of the Directive from the date of member state implementation. This disclaimer is structured as a genuine safety warning system and does not purport to exclude strict product liability where applicable.

14.4 United States

For users in the United States, this disclaimer is a notice only, not a waiver. It does not purport to waive TFC's liability for gross negligence, which is void under California Civil Code §1668 and equivalent provisions in applicable US states. A clickwrap acceptance mechanism is implemented for paid program participants - see Section 11.

Nothing in this disclaimer constitutes a waiver of any right that cannot be waived under applicable US federal or state consumer protection law.


15. Governing Law and Dispute Resolution

This disclaimer is issued by The Foot Collective Pty Ltd under the laws of Queensland, Australia. To the extent required by law in your jurisdiction, mandatory consumer protections in your jurisdiction apply, and nothing in this clause overrides those protections.

For users outside Australia, any dispute arising from access to or use of TFC's content that cannot be resolved by agreement may be referred to arbitration under the ACICA Arbitration Rules. The seat of arbitration is Brisbane, Queensland, Australia. Awards may be enforced under the Convention on the Recognition and Enforcement of Foreign Arbitral Awards (New York Convention, 1958), to which Australia is a signatory.

US users: The foregoing arbitration notice does not waive any non-waivable rights under applicable US federal or state law.


16. US State Privacy Rights

California residents: For information about your privacy rights under the California Consumer Privacy Act (CCPA) and California Privacy Rights Act (CPRA), see TFC's Privacy Policy at https://thefootcollective.com/policies/privacy-policy and TFC's US State Privacy Rights notice. This includes the right to opt out of the sale or sharing of your personal information.

All US state privacy law residents: TFC's Privacy Policy at https://thefootcollective.com/policies/privacy-policy addresses the privacy rights of residents of US states with active consumer privacy legislation, including California, Virginia, Colorado, Connecticut, Utah, Washington, Texas, Oregon, Montana, Tennessee, New Hampshire, New Jersey, Delaware, Iowa, and Nebraska.


17. DMCA and User-Generated Content

If TFC's platforms accept user-generated content (community content, user-submitted videos, comments), TFC's DMCA designated agent information is published consistent with 17 U.S.C. §512(c). For DMCA notices and IP infringement claims, contact: info@thefootcollective.com.

Any user-generated content submitted to TFC's platforms is subject to the licensing terms set out in the applicable TFC membership agreement (Pro Membership Service Agreement or Explorer Membership Service Agreement) and the TFC Terms of Service.


18. Updates to This Disclaimer

TFC may update this disclaimer from time to time. The version number and effective date in the header of this document reflect the current version. TFC archives prior versions with their effective date range. Continued access to TFC's content after an updated version of this disclaimer is published constitutes acceptance of the updated terms for browse-wrap access. For paid program participants and app users, material changes will be communicated via announcements through the app.
